§ 1 Scope
The Kniffelix Community is a multimedia community that allows users to upload and publish their own content, such as texts or images, on the platform. The goal is to promote discussion and exchange on scientific topics.
The following terms of use govern the relationship between the Hamburg University of Technology (hereinafter TUHH) and the users of the Kniffelix Community.
§ 2 Services of TUHH
1. TUHH provides this service to users free of charge within its technical and economic capabilities. TUHH endeavors to keep its services available. TUHH does not assume any further performance obligations; in particular, the user has no claim to constant availability of the service.
2. TUHH assumes no warranty for the accuracy, completeness, reliability, timeliness, and usability of the provided content.
§ 3 Rights and Obligations of Users
1. Kniffelix is intended exclusively for private use.
2. The user undertakes towards TUHH not to make public or distribute any content that violates good morals or applicable law, in particular
– whose publication constitutes a criminal offense or an administrative offense,
– which infringes copyright, trademark law, competition law, or possible industrial property rights,
– which contains offensive, racist, discriminatory, or pornographic content
3. The user undertakes not to post personal data such as telephone numbers, postal and email addresses, instant messenger contact details.
4. The user is solely responsible for all content posted by them.
5. Uploading executable files is not permitted.
§ 4 Data Protection
The data protection regulations applicable to Kniffelix can be accessed at any time at https://www3.tuhh.de/kniffelix/datenschutzerklaerung/.
§ 5 Content Moderation
1. Kniffelix strictly adheres to the applicable youth protection regulations. All content on Kniffelix is pre-moderated. This means that Kniffelix employees read submitted content before publication and, in case of violation of the terms of use and legal regulations, may not allow it to be published, block it, or delete it in whole or in part.
2. Pre-moderation applies to all content published within Kniffelix.
3. TUHH reserves the right to reorder, restructure, archive, and move content, or to delete it for editorial reasons.
4. The user has no claim against Kniffelix for the publication of content, the lifting of a ban, or the reinstatement of content that has already been deleted or blocked.
5. Blog posts are open to all users for free and critical discussion. They are generally supervised by moderators. TUHH reserves the right to delete impermissible content without prior notice to the author. The same applies in case of violations of these terms of use.
§ 6 Links
1. TUHH is generally not liable for the content of links to third-party websites. The university has no influence on their content. Linking from Kniffelix to commercial offers is prohibited.
2. TUHH reserves the right to delete links posted by users if it receives notification that they lead to pages containing impermissible content.
3. TUHH reserves the right to generally prohibit users from publishing links.
4. The user agrees that third parties may link to or refer to the public content posted by them on Kniffelix from outside.
§ 7 Transfer of Usage Rights/Copyright Regulations
1. The copyright for the posted content remains with the respective user. By posting their own content, the user grants the provider a simple, unlimited in time, transferable right of use. The granted right of use continues to be valid even after the termination of the user’s membership.
2. TUHH is entitled to carry out promotional measures for Kniffelix in the context of publicly accessible content and using the same.
3. The user further permits Kniffelix to edit the posted content, in particular to adapt it to the format requirements necessary for use or to improve the display quality, but also to combine it with other content.
§ 8 Limitation of Liability
1. TUHH is liable only for damages resulting from intentional or grossly negligent breaches of contract, as well as for damages resulting from slightly negligent breaches of essential contractual obligations. In the latter case, liability is limited to the damage that is typically foreseeable at the time of contract conclusion. The aforementioned limitations of liability also apply in cases of breaches of duty by employees, representatives, or vicarious agents of Kniffelix. Otherwise, the statutory provisions apply.
2. The user indemnifies Kniffelix from third-party claims that may be brought against Kniffelix due to a legal violation in connection with the content posted by them. The indemnification also includes the costs of appropriate legal defense.
§ 9 Modification or Termination of the Service
1. TUHH is entitled to make changes to Kniffelix.
2. TUHH is entitled to terminate Kniffelix at any time. In the event of termination of Kniffelix, TUHH is entitled but not obliged to delete the content created by the users.
§ 10 Miscellaneous
1. TUHH is based in Hamburg, Germany. The law of the Federal Republic of Germany applies to the legal relationships between Kniffelix, represented by TUHH, and the members of Kniffelix. The place of jurisdiction is Hamburg.
2. TUHH reserves the right to change the terms of use with effect for the future.
